WHAT IS A LAND SETTLEMENT?
BACKGROUND
  • started in the 1940’s by the Government
  • 337 settlements island wide
  • residential/ agricultural lots
  • means of redistributing land

TERMS OF ALLOTMENT

  • allottees given 25 years to pay 
  • registered title to be issued to allottees by Commissioner of Lands
  • no further subdivision allowed
  • sale/transfers to third parties only  with the consent of the Commissioner of Lands

THINGS YOU SHOULD KNOW

  • The Commissioner of Lands has several Titles belonging to deceased persons, but cannot give Title to the next of kin or   beneficiaries, if Letters of Administration or Probate is not available in the estate of a deceased person.
  • The process of administering the estate of the deceased allottee is necessary as the law requires that either Probate or Letters of  Administration be granted to appropriate persons to enable them to deal with the property of deceased persons.

The Probate Unit is designed to assist beneficiaries and /or relatives in obtaining Letters of Administration or Probate.

COSTS
  • Administrative fee  $5000.00
  • Statutory costs – death duties, taxes
  • Advertising fee
  • Fees for the Registrar General/ Administrator General, where applicable

DOCUMENTS THAT MAY BE REQUIRED
Interested persons may be required to provide some or all of the following documents:

  • Original copies of the : Death Certificate or Original Burial Order for settler, Spouse and Children of settler who predeceased or died after settler,
  • Original Funeral Receipt,
  • Original Will (if any), and
  • Names, Addresses, Birth Certificates and Occupation for surviving spouse and children,
  • Marriage Certificate for settler (if any), and
  • Names, Addresses, and Occupation of Executors.
